Welcome to Alky LLC. These Terms & Conditions (“Terms”) govern your use of our website and services. By accessing or placing an order, you agree to be bound by these Terms.

1. Eligibility & Legal Compliance

By using this website, you confirm that:

• You are at least 21 years old (or the legal drinking age in your jurisdiction)

• You are legally permitted to purchase and possess alcohol

• You will comply with all applicable local, state, and international laws

Alky LLC does not assume responsibility for verifying the legality of alcohol shipment to your location.

2. Nature of Service

Alky LLC acts as a facilitator between customers and licensed suppliers.

• We do not manufacture alcoholic products

• All products are sourced from licensed distributors

• Availability, pricing, and product details are subject to change without notice

3. Orders & Acceptance

• Placing an order does not guarantee acceptance

• Orders are only confirmed when:

  • Reviewed and approved by Alky LLC, and

  • Status changes to “Processing” or “Awaiting Shipment”

We reserve the right to:

• Cancel or refuse any order

• Limit quantities

• Request additional verification

If an item is unavailable, we may:

• Offer a substitute

• Delay fulfillment

• Cancel the order with a full refund

4. Pricing & Payment

• Prices are subject to change at any time

• Payment is only captured once the order is accepted

• Additional charges may apply due to:

  • Shipping cost changes

  • Taxes, duties, or regulatory fees

  • Carrier surcharges

You agree to pay all applicable costs before shipment.

5. Shipping & Delivery

5.1 Shipping Options

Shipping methods provided at checkout are optional. You may:

• Use our shipping partners, or

• Arrange your own licensed courier or carrier

5.2 Delivery Terms

• Delivery time begins once the carrier collects the order

• Typical delivery: 1–5 business days (location dependent)

• Delivery requires:

  • Adult signature (21+)

  • Valid government-issued ID

We do not ship to:

• P.O. Boxes

• APO/FPO addresses

• Carrier pickup locations (e.g., UPS/FedEx stores)

5.3 Failed Delivery

If delivery fails due to:

• No adult present

• Incorrect address

The customer is responsible for:

• Return shipping fees

• Re-delivery costs

6. Risk & Title Transfer

• Ownership transfers at the point the order is handed to the carrier

• All shipping is performed by third-party carriers

• Alky LLC is not liable for:

  • Loss

  • Theft

  • Delay

  • Damage during transit

Any claims must be directed to the carrier unless insurance is purchased.

7. Insurance

• Shipping insurance may be offered at checkout

• Certain high-value orders may require insurance

If insurance is declined:

• You assume full responsibility for:

  • Damage

  • Theft

Claims must be submitted within the insurer’s required timeframe.

8. Customer-Arranged Shipping (CAP)

You may arrange your own shipping service:

• Alcohol shipments must comply with:

  • All applicable laws

  • Hazardous goods regulations (if applicable)

Orders must be collected within 10 business days, or they may be cancelled.

9. Returns & Cancellations

Before Shipment

• Orders may be cancelled for a full refund

After Shipment

• Returns are subject to:

  • Shipping costs

  • Handling fees

No refunds for:

• Failed delivery attempts

• Incorrect address provided

• Variations in bottle design, label, or vintage

10. Damaged or Missing Items

• Inspect your package upon delivery

• Report damage immediately with:

  • Photos

  • Packaging evidence

Claims may result in replacement or refund after review.

11. Fraud Prevention & Verification

We reserve the right to:

• Request ID verification

• Delay or cancel suspicious orders

• Refuse transactions that violate legal requirements

Orders with mismatched billing/shipping details may require additional checks.

12. Legal Disclaimer

Alcohol Warning

• Do not consume alcohol during pregnancy

• Alcohol impairs driving and machinery operation

Jurisdiction Responsibility

You are responsible for ensuring that:

• Alcohol shipment is legal in your jurisdiction

• You comply with all applicable laws

By placing an order, you authorize Alky LLC to engage a carrier on your behalf (if applicable).

13. Limitation of Liability

To the fullest extent permitted by law:

Alky LLC shall not be liable for:

• Indirect or consequential damages

• Loss of profits or business

• Delays or failures caused by third parties

Our total liability shall not exceed the amount paid for the order.

14. Force Majeure

We are not responsible for delays or failure to perform due to events beyond our control, including:

• Weather

• Carrier disruptions

• Regulatory changes

• Supply chain issues

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which Alky LLC operates, without regard to conflict of law principles.
